General Eviction information
Generally, an eviction occurs when then Tenant fails to pay rent. Florida law requires an attorney or the Owner to appear for eviction cases. With this service, ORPM will pay an attorney to represent you. See FAQ #4 below.
How much is the Eviction Protection Plan ('E.P.P.')?
- $96 per property for a lease up to 380 days (12.5 months), OR
- 26.3 cents per day per property for a lease over 380 days
- Example: a 13 month lease agreement is approximately 390 days and would be a charge of $102.57 charged from the first month's rent.
- If after the completion of a lease, a Tenant agrees to lease the property on a 'month to month' basis or other short term lease (less than 11 months), the fee shall be at 26.3 cents per day per property.
What happens if the tenant fulfills the normal lease term, but then goes 'month to month', or goes ‘month to month’ then renews for a year lease, or goes ‘month to month’ then is replaced by a new tenant on a year lease? (See the examples below):
- Lease start date of January 1st for Tenant A.
- The owner is billed $96.00 for the service at the start of the lease with Tenant A.
- Before the lease end date of December 31st, the owner agrees to allow Tenant A to stay on a month to month basis.
- The owner will be billed 26.3 cents per day during the month to month time period. This will be collected from the monthly rent.
- Tenant A decides to exit the from a month to month lease and signs another full lease term, the Owner will be billed $96.00 at the start of the next lease term.
- Tenant A while on a month to month, provides notice to move out. Tenant B is located for the property, the Owner will be automatically billed $96.00 at the start of Tenant B's lease unless the Owner notified ORPM in writing in canceling the service.
What does the E.P.P. cover?
ORPM will pay nearly all of the fees in connection with an eviction of a Tenant placed and managed by ORPM up to a combined maximum of $1500.00. The following describe the included fees:
- Court costs
- Process Serving Fees
- Serving of 3 or 7 day notices
- Administrative costs and fees
- Filing of the Writ of Possession
- Likely attend court on your behalf (always with the attorney)
- Meeting the sheriff at the property to take possession back from the Tenant
- And most expensive: Attorney and Legal Costs!
When do you typically file the eviction?
Typically between the 19th and the 21st of the month.
Why don't you evict the tenant earlier than the 19th of the month?
From our attorneys advice and our own experience, it is very typical that judges will have compassion for a tenant when it comes to evictions that are filed for unpaid rent. If the tenant is given additional time to pay the rent and still does not have the rent monies, the judge will be more likely to sign the documents to remove the tenant.
If I, the owner, want to delay the eviction filing past the 21st, and give the tenant additional time to pay the rent, can I?
Yes. We typically will advise that the 'line in the sand' should be the 21st of the month, but if you would like to give the tenant a few extras days you must do so by providing that request in writing.
If a Tenant is unfortunately evicted from the property after say 6 months, do I have to pay another $96 service fee for the next Tenant?
Yes.
If I decide 30 days into the lease I do not want the Eviction Protection Plan, can I cancel the plan?
- The plan is non-refundable once the lease agreement begins.
- Before the lease agreement ends, advise us in writing that you would like to not participate in the plan once the current lease expires and you will not be charged again.
Does this plan include paying the unpaid rent, repairs, cleaning, etc. at my property after the Tenant has been evicted?
- No. The Tenant's security deposit monies would go toward Tenant damages and unpaid rent.
- If you are interested in a plan to cover unpaid rent, repairs, cleanings, etc., please contact our office.
Does Orlando Realty and Property Management reserve the right to not offer E.P.P. at any time for any reason?
- Yes.
- Of course, any and all current plans will be honored through the full term of an initial lease agreement.
I have never had an eviction before, do I need this plan?
Of course this is ultimately your decision. Keep in mind that if you own a rental property long enough, chances are an eviction on your property will occur, even with a tight screening process.
